General Terms and Conditions (GTCs)
1 Area of application
These General Terms and Conditions of Beerbaum Stables GmbH apply to the legal relationship established by the purchase of day tickets and/or other admission tickets ("Tickets") in the online ticket shop at www.tickets.riesenbeck-international.com or in stationary sales (e.g. box office) of Beerbaum Stables GmbH and/or the use of the Tickets.
2 Conclusion of contract
2.1 Online ticket shop
The item descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller but serve for the submission of a binding offer by the customer. The customer may submit the offer via the online order form integrated into the Seller's online shop. After placing the selected tickets in the virtual shopping cart and going through the electronic ordering process, the customer submits a legally binding contractual offer with regard to the tickets contained in the shopping cart by clicking the button that concludes the ordering process. Orders may not be subsequently changed or cancelled. A right of withdrawal is excluded by law (§ 312g BGB). Beerbaum Stables GmbH will confirm receipt of the contract offer to the customer online. The confirmation does not yet constitute an acceptance of the customer's offer, but is subject to the availability of the ordered tickets and the consideration of special circumstances (e.g. security aspects). Only upon dispatch (print@home ticket and mobile ticket) does the contract between Beerbaum Stables GmbH and the customer come into effect on the basis of these GTCs.
If the customer has set up a user account in the online shop of Beerbaum Stables GmbH before sending his order, the order data will be archived on the website of the seller and can be accessed by the customer free of charge via his password-protected user account by providing the corresponding login data.
2.2 Offline order
In the case of offline orders, in particular via the authorized advance booking offices, the contract is concluded at the time of dispatch or handover of the ticket on the basis of these GTCs.
2.3 Deposit
If tickets are deposited at the service points set up by Beerbaum Stables GmbH for collection by the customer, the collection of the tickets is only possible by the customer, or a third party authorized in writing by the customer upon presentation of an official ID or other official document suitable for identification. Beerbaum Stables GmbH may charge an appropriate deposit fee for the deposit of the ticket.
2.4 Discounted tickets
If the customer purchases a ticket at a reduced price, which is granted by the seller if defined conditions are met (e.g. in the case of a severe disability, falling below or exceeding an age limit, etc.), the ticket is only valid upon simultaneous presentation of the corresponding proof of entitlement to the discount. The proof must be presented at the entrance to the event without being asked. If no such proof is presented, there is no entitlement to admission. The seller can allow access against payment of the difference on site but is not obliged to do so.
3. Payment modalities
3.1 Ticket prices
The ticket price is based on the current price list of Beerbaum Stables GmbH. Ticket orders will only be processed against advance payment and with the accepted payment methods. In addition to the ticket price, Beerbaum Stables GmbH may charge the buyer shipping costs and/or a reasonable service fee for services that are in the buyer's interest (e.g. advance booking fee) in the case of ticket dispatch. This is shown transparently in the case of the online ordering process.
3.2 Payment options
The customer will be informed of the payment option(s) in the online shop of Beerbaum Stables GmbH. Other methods of payment are not accepted.
3.2.1 PayPal payment method
When payment is made using a payment method offered by PayPal, the payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or - if the customer does not have a PayPal account - subject to the Terms and Conditions for Payments without a PayPal Account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.
3.3 Payment method credit card, direct debit
If the payment method credit card or direct debit is selected, the payment will be processed via the payment service provider GiroSolution GmbH, Hauptstraße 27, 88699 Frickingen. Further information on the procedure can be found at: https://www.girosolution.de.
3.4 Cancellation
Should payment not be successfully made for reasons for which the customer is responsible (e.g. insufficient credit card or bank account coverage, chargeback), Beerbaum Stables GmbH is not obliged to consider the order or is entitled to electronically block the corresponding tickets, if already handed over for whatever reason; the corresponding tickets lose their validity. Beerbaum Stables GmbH reserves the right to assert claims for damages.
4. Passing on of tickets
In order to avoid violence and criminal offences in connection with the attendance of the event, to enforce terrain bans and to prevent the resale of tickets at excessive prices, it is in the interest of Beerbaum Stables GmbH and the safety of the spectators to restrict the passing on of tickets.
4.1 Impermissible transfer
The customer undertakes and expressly assures to acquire and use the tickets exclusively for private purposes. The purchase for commercial (i.e. for profit) resale is prohibited. In particular, the ticket purchaser is prohibited from reselling tickets commercially; in the event of private resale (e.g. in the event of illness or incapacity); to charge a higher price than the price paid; a price surcharge of up to 15% on the pure ticket value to compensate for transaction costs incurred is permissible; to use or allow to be used commercially or commercially without the express prior written consent of Beerbaum Stables GmbH, in particular for the purposes of advertising, marketing, as a bonus, as a promotional gift, as a prize or as part of an unauthorized hospitality or travel package; to pass on
tickets for events against payment or free of charge to persons who are subject to a nationwide ban or a ban restricted to the premises of Beerbaum Stables GmbH, provided that the ticket holder is aware of this or should have been aware of this.
4.2 Permissible transfer
In the event of a permissible transfer, this is only permissible if the conditions and restrictions associated with the Ticket continue to apply in accordance with these General Terms and Conditions. The purchaser shall expressly inform the subsequent purchaser or the new Ticket Holder of the validity and content of these General Terms and Conditions.
5. Withdrawal and Refund
5.1 No right of revocation or return:
Even if Beerbaum Stables GmbH offers tickets via means of distance communication within the meaning of § 312c para. 2 BGB (German Civil Code) and thus a distance contract may exist pursuant to § 312c para. 1 BGB, the customer has no right of revocation when purchasing a ticket pursuant to § 312g para. 2 no. 9 BGB. Any submission of an offer or order for tickets is thus binding immediately after confirmation by Beerbaum Stables GmbH pursuant to section 2.1 and obliges the customer to accept and pay for the ticket(s) ordered.
5.2 Exchange and return:
Exchange and return of tickets are generally excluded.
5.3 Postponement:
If the scheduling of an event is rescheduled to another date, the purchased ticket is valid for the new event date. In this case, the ticket holder has the right to return the purchased ticket against reimbursement of the ticket costs and any surcharge.
5.4 Cancellation of the event and exclusion of spectators:
In the event of cancellation of the event without replacement or in the event of an event which, according to the provisions of a competent association or a competent authority, must take place in whole or in part with the exclusion of spectators, Beerbaum Stables GmbH is entitled to withdraw from the contract for the purchase of one or more tickets for the event concerned. The affected customers will be refunded the ticket price paid upon presentation of the ticket or sending the ticket to Beerbaum Stables GmbH at their own expense.
5.5 Cancellation of the event
If the event is cancelled, there is no entitlement to a refund of the ticket price, unless the organizer is at fault for the cancellation of the event.
5.6 Repeat Event
In the event of a repeat event after the actual event has been cancelled, the repeat event shall be deemed to be a new event; the Ticket for the original event shall no longer be valid for this purpose and the Ticket Purchaser shall not be entitled to a refund or other compensation.
6. Site regulations, orders and exclusion during the event
The instructions of the police, the Beerbaum Stables GmbH, the security staff and the grounds management on the grounds must be followed.
6.2 Right of access
Each customer is entitled to one-time access to the premises upon presentation of the valid ticket. Access to the premises may nevertheless be refused if:
a) the customer or ticket holder refuses to submit to an appropriate check of his person and/or the items he is carrying by the security personnel before entering the bounded area of the premises, at the entrance to the premises and/or in the interior of the premises, in order to ensure that no items prohibited by the rules and regulations of the premises are brought into the bounded area;
b) the customer or ticket holder has already entered and subsequently left the perimeter area once within the framework of the same event; in this case, the ticket shall lose its validity unless the customer has a justified interest in leaving the perimeter area (e.g. in an emergency) and has left the perimeter area by means of an emergency exit ticket. emergency) and has left the premises by proper check-out in consultation with the responsible security personnel,
c) the ticket holder is obviously intoxicated or under the influence of drugs,
d) the imprint on the tickets (space, barcode, QR code, serial numbers, shopping basket or buyer identifications) is manipulated unrecognizable and/or damaged or the barcode/QR code has already been marked as used in the electronic access system, insofar as Beerbaum Stables GmbH is not responsible for this and/or
e) The ticket holder is subject to a nationwide ground ban or a ground ban applicable to the specific venue and he/she does not prove that the ground ban has been overridden by a court decision.
In the event of justified refusal of admission, the customer or ticket holder shall not be entitled to compensation.
6.3 Domiciliary rights and seat allocation
Each ticket holder must occupy the seat on the grounds or in the stands that is indicated on his/her ticket or for which his/her ticket is valid. In the interest of safety and the orderly and smooth running of the event, the ticket holder is obliged to follow the instructions of the police, Beerbaum Stables GmbH, the security staff and the grounds management on the grounds, in particular to take a different place than that indicated on the ticket if requested to do so for objective reasons; in this case there is no entitlement to compensation.
Obviously intoxicated persons, persons under the influence of drugs, hooded persons and persons who behave violently may be expelled from the premises without compensation.
6.4 Prohibited items
The following items may not be brought to Beerbaum Stables GmbH events: Weapons, items that can be used as weapons or projectiles, corrosive and easily flammable substances, bottles, cans, mugs, jugs, torches, fireworks, smoke candles, Bengal fires, alcoholic beverages, illegal drugs, animals, disruptive devices such as laser pointers and any other items that are likely to endanger or unreasonably interfere with other visitors, participants or officials or the course of the event.
Advertising, commercial, political or religious items of any kind, including banners, signs, symbols and leaflets, are not permitted and may not be brought onto the premises if Beerbaum Stables GmbH has reason to believe that they will be displayed on the premises.
Anyone who brings prohibited objects with them or possesses or uses them during the event may be excluded from attending the event by the organizer or its security service. Prohibited items may be confiscated for the duration of the event.
6.5 Xenophobic, racist behavior and/or right-wing or left-wing extremist propaganda material
It is prohibited to carry racist, xenophobic and/or right-wing or left-wing extremist propaganda material of any kind, including banners, signs, symbols and flyers, if there is reason to believe that these will be displayed inappropriately on the grounds. Irrespective of the objects carried, the utterance or dissemination of inhuman, racist, xenophobic, politically extremist, obscenely offensive, provocatively insulting and/or left-wing or right-wing radical slogans as well as corresponding actions on the entire grounds are prohibited.
7. Prohibition of carrying recording devices, own recordings
Tape recorders, film, photo or video cameras may not be carried or operated at the event. The carrying of mobile phones, even if they have a photo and/or video function, as well as amateur cameras for the production of recordings exclusively for private use, e.g. for souvenir purposes, remains permissible. Any violation of these regulations will be prosecuted by means of criminal and house law.
Insofar as recordings/videos are made with the equipment carried, this is only permitted for private, non-commercial purposes. Video sequences may not exceed a length of 30 seconds.
8 Right to one's own image, image and sound recordings
The ticket purchaser or holder acknowledges that image and sound recordings may be made by the organizers at any time. Each ticket holder irrevocably consents for all present and future media to the free use of his/her image and voice for photographs, live transmissions, broadcasts and/or recordings of image and/or sound made by Beerbaum Stables GmbH or by authorized third parties in connection with the event. § Section 23 (2) of the German Art Copyright Act (KunstUrhG) remains unaffected.
9 Contravention of the ticket conditions
In the event of a violation of the General Ticket Conditions, Beerbaum Stables GmbH reserves the right to expel the ticket holder from the venue or to issue a general ban from the premises.
10 Data protection
For Beerbaum Stables GmbH compliance with the applicable data protection regulations is a matter of course. Beerbaum Stables GmbH uses the data within the framework of the statutory provisions, e.g. for the execution of the contract or to inform customers about the goods or services of Beerbaum Stables GmbH that are similar to the goods or services they have ordered. The customer may at any time object to the use or transmission of his data for advertising purposes or purposes of market or opinion research at Beerbaum Stables GmbH. Beerbaum Stables GmbH will inform the customer of this right of objection each time it contacts the customer for advertising purposes. Beerbaum Stables GmbH will point out any other purposes for which the data may be used when collecting the data. If the customer wishes to object to the use of his or her data for advertising purposes as a whole, it is sufficient to send a message to: Beerbaum Stables GmbH, Surenburg 20, 48477 Hörstel or info@riesenbeck2023.com.
11. Alternative dispute participation
We would like to point out that we are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board (cf. § 36 VSBG).

13 Final clause
Should individual clauses of these GTCS be invalid in whole or in part, this shall not affect the validity of the remaining clauses or the remaining parts of such clauses.
